The arbitrator may not consolidate more than one person or entity claims and may not otherwise preside over any form of a representative, class, or consolidated proceeding. If this class action waiver is found to be unenforceable for any reason, then the entirety of this dispute resolution section shall be null and void, and any dispute shall proceed in the courts of competent jurisdiction as provided in the governing law section of these terms.

19. General Provisions
Entire Agreement. These Terms of Service, together with our Privacy Policy and any other agreements or policies expressly incorporated by reference herein, constitute the entire agreement between you and Yus Global with respect to your access to and use of the website and services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the subject matter hereof. No course of prior dealings between the parties and no usage of trade shall be relevant to supplement or explain any term used in these terms.
Severability. If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these terms will continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified, amended, or limited only to the extent necessary to render it valid, legal, and enforceable, and you and Yus Global hereby consent and submit to the jurisdiction of the court for this purpose.

No waiver by Yus Global of any term or condition set forth in these Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Yus Global to assert a right or provision under these terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Yus Global to be effective.
Assignment. You may not assign or transfer these Terms of Service, or any of your rights or obligations hereunder, whether by operation of law, merger, change of control, or otherwise, without the prior written consent of Yus Global. Any attempted assignment or transfer in violation of this provision shall be null and void and of no force or effect. Yus Global may assign, transfer, or delegate these Terms of Service, in whole or in part, at any time without notice to you and without obtaining your consent. These terms shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors and permitted assigns.
Force Majeure. Yus Global shall not be liable for any failure or delay in performance of its obligations under these Terms of Service arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including without limitation acts of God, natural disasters, earthquakes, hurricanes, floods, fires, epidemics, pandemics, public health emergencies, war, terrorism, civil unrest, riots, acts of governmental authorities, changes in law, embargoes, strikes or other labor disputes, interruptions in telecommunications or internet services, power outages, utility failures, or failure of third-party service providers. The time for performance of any obligation affected by such circumstances shall be extended by a period equal to the duration of the force majeure event plus a reasonable period for recovery.
Relationship of the Parties. Nothing in these Terms of Service shall be construed as creating a partnership, joint venture, agency, fiduciary, or employment relationship between you and Yus Global. Neither party has the authority to bind the other or to incur any obligation on the behalf of the other without the prior written consent of the other party. You and Yus Global are independent contractors, and each party is solely responsible for its own employees, agents, contractors, and operations.
Headings and Interpretation. The section headings used in these Terms of Service are for convenience of reference only and shall not affect the meaning or interpretation of any provision hereof. Whenever the words include, includes, or including are used in these terms, they shall be deemed to be followed by the words without limitation. The use of the singular shall include the plural and vice versa, and the use of any gender shall include all genders, as the context may require.
Survival. All provisions of these Terms of Service which by their nature should survive termination shall survive, including without limitation the provisions relating to intellectual property rights, confidentiality, disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and any other provision that, by its terms, is intended to continue beyond the termination of these terms.
